Facing legal questions, Gov. Evers responds to ACA lawsuit critiques

EAU CLAIRE, Wis. (WSAW) – Following a Wisconsin legislative lawyer’s analysis, Gov. Tony Evers can't order the attorney general to withdraw from a lawsuit seeking repeal of the federal health care law. Gov. Evers said Wednesday it is up to Attorney General Josh Kaul how to proceed.

"My intent is quite simple. To get out of the lawsuit with other states that are opposing the Affordable Care Act,” Gov. Evers said. “The attorney general will not do something that's illegal. And I trust him and his experience in how to move forward."

The memo says only the legislature's Republican-controlled Joint Committee on Finance, not the governor, can discontinue a lawsuit.

Senate Pres. Scott Fitzgerald says "current law is very clear" and any action Kaul takes must follow the law.

A spokesperson for Kaul has not returned NewsChannel 7’s request for comment.
