UPDATE: No Jail Time for Man Convicted of Threatening Wausau West Student

The Rothschild man convicted of threatening a Wausau West student through a series of text message could have the option to have the charges expunged from his record if stays out of trouble for the next five years.

Wednesday morning in Marathon County Court, Marcos Garza pleaded no contest to threatening to injure someone, using a computer message to threaten and carrying a concealed weapon.

As conditions of his sentence, he must live with his father and obey all house rules. He may not possess a dangerous weapon, and will have to write a letter of apology to Wausau West High School.

He was also sentenced to three years probation. Garza was also sentenced to 180 days in jail, however since he has been in jail since the incident he will received credit of 180 days for time served and will be released from jail after meeting with his probation officer.

A 19-year-old Rothschild man charged with sending threatening text messages to a Wausau West student prompting a school lock down last fall, is expected to reach a plea deal with prosecutors Wednesday and will avoid a jury trial.

Marcos Garza is charged with threatening to injure someone, using a computer message to threaten and carrying a concealed weapon. He has already pleaded not guilty to the misdemeanor charges.

According to court documents, Garza sent numerous text message to the student stating he had a gun was going to hurt students at the school, saying "It's not going to be pretty." Garza also told the girl she "Wouldn't make it in for work tonight".

The student told a staff member about the texts and police were notified. National protocol calls for schools to go into lock down mode when a threat is present and that protocol was followed as the school when into “Code Yellow” lock down around 11:45 am. “Code Yellow” means students must stay in their classrooms, lock the doors and no traffic is allowed in or out of the school.

Police were able to locate Garza within an hour of initiating the lock down. Police say he willingly came out of his residence, but he was armed with a handgun. No injuries were reported.

He remains behind bars on a $25,000 cash bond.
