UPDATE: Police: Thorp Track Coach Violates Bond by Making Contact with Teen

UPDATE: 3/14 at 1:53 p.m.

Scott Bergman is behind bars on a $20,000 cash bond. A judge ordered he have no contact with the 17-year-old girl, her mother, the woman the girl had been living with, or his roommate.

He'll return to court April 11th for an initial appearance when he's expected to be charged with two counts of bail jumping.

A former assistant Thorp track coach accused of having a relationship with a student is facing a new charge after investigators say he violated the conditions of his bond by having contact with the girl.

The Clark County Sheriff's Department says they received a tip that Scott Bergman, 43, would be making contact with the 17-year-old girl on Wednesday night. The Sheriff's Department and Thorp Police Department followed both Bergman's and girl's vehicles to a church northeast of Thorp in the village of Lublin and found the two together.

They arrested Bergman on a Felony Bail Jumping Charge. A condition of Bergman's bond was that he have no contact or communication with the girl.

Bergman told investigators he was meeting the girl to give her an Easter basket.

Bergman is in the County Jail, and could be in court as early as Thursday.

A former assistant track coach at Thorp High School made his initial court appearance Thursday on allegations he had a sexual relationship with a 17-year-old student.

Scott Bergman, 43, faces a felony charge of sexual assault of a student by school staff. He's free on a $2000 cash bond.

According to the criminal complaint, the relationship between Bergman and the 17-year-old girl began last fall, when he was her coach at the school. Police were contacted by the Thorp District Administrator, who had been told about a possible relationship between Bergman and the student.

A search warrant of Bergman's phone turned up nude and partially-nude pictures of the girl, and intimate text messages between the two.

Besides the felony charge of sexual assault of student by school staff, Bergman is also facing two misdemeanors of having sex with a child over 16. The District Attorney's office says the most recent incidents were charged as misdemeanors, because they happened after the school board decided to terminate Bergman, on November 7th.

According to investigating officers, the 17-year old victim's parents knew there was a relationship and did not want to see Bergman prosecuted.

According to the criminal complaint, Bergman is a long time family friend and was the victim's track coach for 5 years. The victim admitted in a journal entry that she lied to police when initially questioned. In a copy of her journal obtained by police she wrote, "I completely lied through my teeth, but honestly, if it keeps Scott from going to jail you better freaking believe I'm going to do it." The two considered getting married in order to avoid any charges.

"Parents can't give their children consent to have sex", said Assistant District Attorney Richard Lewis. "They can actually give a 17-year-old consent to get married.. Counts 2 and 3 then would not be available on a 17 year old girl that's married with parental consent." Those two counts were misdemeanor charges of having sex with a minor older than 16.

He adds that since the two were not married when the alleged sexual encounters occurred, even if they get married now it would not change the charges in the case.

Thursday's court appearance was brief, lasting less than five minutes. Bergman waived his right to a preliminary hearing. He is scheduled for a pre-trial conference on February 26th. If convicted, he could receive a maximum of seven and a half years in jail and up to $30,000 in fines.
