UPDATE: Man Accused of Killing Girlfriend Pleads Not Guilty

An Adams man accused of killing his girlfriend because he says she startled him in the middle of the night has pleaded not guilty.

Coleman Dybul is expected to face a jury, however a future court date has not been set.

The criminal complaint detailing the events leading up to the death of Toni Voss tells the story of a happy couple with plans to wed.

Coleman Dybul says he met Toni Voss in 2008 while attending school at Mid-State Technical College. He says they began dating in May 2012 and moved in together shortly after.

According to the criminal complaint, Coleman Dybul tells officers on March 2, around 2 a.m. he fired a shot from the rifle he kept near his bed after he thought an intruder had broken into his house and was attacking his girlfriend.

Dybul said he turned on the light and begun applying pressure to her chest, and called 911.

An autopsy shows Voss died from a gunshot wound to the chest.

Dybul says he does suffer from PTSD and had previously been on medication to treat it. During the initial interview with police, his instinct was to protect his family. He tells officers he's not a "crazy veteran guy", he's just a guy trying to have a family.

UPDATE: 3/15 11:09 a.m.

An Adams man accused of killing his girlfriend after he says she startled him in the middle of the night is facing drug charges after toxicology reports show he had THC in his system.

Coleman Dybul returned to Adams County Court Friday morning for an adjourned initial appearance. He's now charged with 1st degree recklessly endangering safety- using a dangerous weapon, possession of THC, and possession of drug paraphernalia.

The prosecution says they'll need more time to file charges against a 28-year-old Adams man accused of killing his girlfriend earlier this month.

Coleman Dybul was expected to be formally charged Monday in Adams County Court, however the prosecution says they're awaiting toxicology results. The findings could mean more criminal charges. An adjourned initial appearance has been scheduled for Friday.

The Adams County Sheriff’s Office says Toni Voss, 27, died on March 2 around 1:48 a.m. From a gunshot wound. Dybul says he was sleeping in bed when she startled him. He grabbed a shotgun which he kept near the bed and shot her. She was pronounced dead at the scene.

Friends say Dybul was a sniper in the Marine Corp and had an active duty tour in Afghanistan. He was severely injured and even received a Purple Heart. Dybul's attorney says they'll be using post traumatic stress disorder, or PTSD as their defense.

He remains behind bars on a $250,000 bond.

A young child was also in the residence at the time of the incident and was unharmed.
