The Fourth District Court of Appeals rejected an appeal from the residents of the town of Montrose. They had argued the permit granted to UW to build the 403-foot tower was invalid.

They cited a county ordinance that says permits are null and void if construction doesn't start within a year of approval.

But the appeals court says the permit remained valid because construction began within one year of final county board action on the permit.

The radio station, WSUM, went on air last year. It's the university's first licensed radio station broadcast on the FM dial.
