An administrative law judge says Jessica Kasten will not have to go to prison.

The 26-year old Wausau woman was arrested for drunk driving with her children in the car in May. She was already on probation for a child neglect resulting in the death of a child conviction.

Kasten is charged with obstruction of justice for allegedly lying to police about whether she had been drinking.

She was sentenced to 10-years probation after pleading no contest to the neglect charge. Authorities say she was sleeping off a meth binge while her 6-month old son stopped breathing and died.

Department of Corresctions spokesman Mike Williams tells NewsChannel 7 an administrative law judge ruled against the department's request to revoke her probation.

However, he says an appeal will probably be filed by Friday. Then, the state has seven days to respond.

Jessica did make bad desicions, but everyone does in their lifetime. I don't think that any child should be without their mother, and jessica should get help. I know we all have our own opinion, but i don't think you guys should be so rough on her and call her a murderer. she is not that, she is an addict. Being an addict wheter it be with alcohol or drugs is very hard to get over and you will do anything to get your fix without thinking of the consequenses. Cut the woman some slack, besides the drugs, i imagine she is a very good mother who loves her kids very much and unconditionally like any one of you. Stop calling her names lapses in judgement can happen to anyone, and yes more than once

what she needs is treatment, not jail time. what would that solve? the kids are in good hands, but they still need their mom. locking her up until they're 30 is just going to victimize them. they already lost a brother, they shouldnt have to lose their mom too.

I as a close family member of Jessica am sick and tired of all the bad publicity you have given Jessica. 1)Her first child past away at 3 months. She LOVED that baby like you wouldn't believe. She was so afraid to go back to work after her maternity leave., but I told her Tim Fochs is the dad and you have to trust him. Little did I know he had been convicted of felony child abuse with one of his other children. Well guess what happened, she went back to work and within 5 days God took her. Tim & his father had all readly introduced her to meth. NOT an excuse but he had her living the life of a recluse. Tim was working both sides of the street. She was always left alone with the kids while he was out COOKING. He had the nerve to show up at Gavins funeral drugged out. Tim is is prison now. (Thank God), but you have to remember those babies that pasted were inside of her, he was never around to help, except to give her more drugs. Jessica is a good person and very good parent.

This is not a miscarriage of justice, it is an abortion! What does she have to do to receive a fair sentence, kill one of the judge's kids?

Wow, she got by with killing one child, how many more need to die before the court system takes her and locks her away for good? This woman deserves no second chance. She blew it when she chose to drive drunk with her two children in her car. This is serious! She is on probation and should have that revoked!

It is so sad to see her go through the first tragedy of killing her baby. Then to have no regards for her other children or the law and others while driving drunk with her children in the car. Is that not an automatic felony in our state? How can she get away with this? There are people in any given community trying so bad to have children and would do anything for them. Then we have people that can have all the children they want and don't even care about or for them. Someone needs to step in and teach this lady a lesson. Do we need to be burying more of her children and she still not learn?

what is wrong with our judicail system????? a child died while she sleeps off a meth high. Messes up again drinking and driving with her child in the car and now they don't want her to go to prison???? people go to prison for writing bad chaecks and DWI's and this girl keeps getting out of this???? C'mon, please. Your making it look like it's ok to do these things. If i went out and got so high i couldn't care for my kids and one died i'd be in prison. That's where i should be. It's murder. This isnt a game.

It is too bad that people don't have to pass some sort of test to be able to have children. It is even more depressing that woman like Jessica aren't locked up for life. To be responsible for the loss of an innocent child is the most horrific of crimes and those people should be punished as such. Life in prison should be considered as getting off easy.
