Notice of Loss Filing for FSA’s ELAP & LIP Extended

The Farm Service Agency announces that producers interested in applying for the Livestock, Honey Bees, and Farm-Raised Fish Program (ELAP) or the Livestock Indemnity Program (LIP) for losses occurring before October 1, 2011, have until, the earlier of 30 days after livestock loss becomes apparent, but no later than December 29, 2011 to file a notice of loss. Since the LIP and ELAP program authorities end with the 2008 Farm Bill, losses due to adverse weather events occurring on or after October 1, 2011 are ineligible for benefits under LIP or ELAP.

To be eligible under LIP and ELAP, livestock losses due to adverse weather events must occur within 60 days of the adverse weather event. Producers must file for losses within 30 days of the deaths becoming apparent. The final date to apply for LIP and ELAP losses is December 29, 2011.

Qualifying producers, owners or contract growers, must have livestock, stored feed, honey bees or farm-raised fish losses from an adverse weather event that occurred before October 1, 2011. These adverse weather events include tornados, lightning, floods, colony collapse, extreme cold, extreme heat, blizzards or winter storms. Documented wolf depredation to livestock is also an eligible loss under the ELAP program.

Once notices of losses are filed for LIP or ELAP, producers will have until January 30, 2012, to submit all required documentation and complete the application for payment.

Adequate documentation must prove the loss occurred as a direct result of an eligible adverse weather event in the calendar year for which benefits are being requested.

USDA’s payment limitations provisions apply to producers enrolling in the disaster programs along with adjusted gross income limitations and conservation compliance. LIP indemnity payments are about 75 percent of the fair market value of the livestock as determined by the Commodity Credit Corporation (CCC). Compensation for qualified losses in ELAP is about 60 percent of the replacement cost for the livestock, forage, honey bees, or farm-raised fish losses within the limitation provided in program provisions.
