A 23-year-old Wausau man accused of using a BB gun to shoot signs out his apartment window and accidentally hitting a person is now free on a signature bond.

Police say on September 5, officers responded to Back When Cafe on 3rd Street in Wausau after patron was shot in the arm while dining outside. The stray BB left a welt on the 43-year-old, but did not cause serious injury.

An observant employee is credited with identifying Daniel Burkhardt, 23, as the suspect. Police say the employee witness noticed Burkhardt's apartment window immediately close after the incident.

Officers went across the street to Burkhardt's apartment. They say he did not initially open the door so a warrant was obtained. Officers surrounded the apartment and Burkhardt opened the door. He admitted to officers he had just purchased the CO2 gun and was shooting signs.

He's charged with injury by negligent use of a weapon, resisting an officer, bail jumping and disorderly conduct. He'll return to court October 3.
