Village of Brokaw Slaps New Paper Mill Owner w/ Restraining Order

The company trying to find a buyer for the old Brokaw Paper Mill is now in a legal battle with the Village of Brokaw.

Since Wausau Paper stopped production of the mill in February of 2012, questions about its future have plagued the community. Now, the Village is worried Brokaw Development LLC, which is responsible for selling the property and its assets, isn't acting in the best interest of taxpayers.

In March, the Village slapped Brokaw Development with a temporary restraining order, forbidding it from removing anything from the property without the proper permit.

According to court documents, the Village alleges Brokaw Development is violating an ordinance that requires the company to have a permit to perform any "razing, scrapping or recycling" of materials from the mill. During an inspection earlier in the year, the village found the company was doing those activities but without the permit.

"The ordinance is intended to protect the Village from blight by requiring plans and insurance and financial assurance before a permit is issued," said the Village's attorney, Bill Scott. "And the Village wants to avoid having all of the valuable assets removed from a property, leaving behind only the liabilities. Because that would tend to cause the property to become abandoned."

Calls placed to attorneys for Brokaw Development on Monday were not returned. But court documents show they did respond to the complaint; they denied all allegations.

In the meantime, Brokaw Development has applied for a permit. So far it is still being reviewed.
