School District Receives Hundreds of Emails After Pulling Student Gay Adoption Piece

Earlier this month Brandon Wegner, 15, a Shawano Community High School sophomore, wrote an editorial in the student newspaper opposing gay adoption. Another student, Maddie Marquardt, wrote an opinion piece right next to Wegners, arguing we can't judge whether someone is a suitable parent simply by their sexual orientation.

But after running in the student newspaper, which appeared as an insert in the Shawano Leader, the opinion pieces have been removed from remaining copies.

Now an attorney with the Liberty Counsel, a non-profit law firm specializing in first amendment rights, is representing Wegner. Harry Mihet says Wegner's first amendment rights have been outrageously violated.

Mihet says Wegner was given the topic of gay adoption. In his opinion piece he quotes the bible and says, "In a Christian society allowing homosexual couples to adopt is an abomination."

After the piece ran, the Shawano School District decided to remove it from the school newspaper.

Mihet says whether you agree with gay adoption or not is irrelevant.

"He did nothing more than to express his opinion on a particular topic, an opinion in which with some are free to agree and some to disagree but an opinion which is absolutely protected with the first amendment of the Constitution" Mihet said.

Mihet alleges the school district superintendent, Todd Carlson, pulled Wegner out of class and made him feel ashamed for his piece.

"The superintendent told him that he had violated the school's bullying policy," Mihet said. "The superintendent also told him he was ignorant and all kinds of demeaning names."

Now Liberty Counsel is demanding the school district give Wegner a sincere apology. They also want the district to make it clear to students and the community that student journalists have the first amendment right to express their opinions.

The firm is threatening litigation against the Shawano School District if they don't comply.

Carlson sent a statement saying the situation has escalated to the point where school district staff have been threatened.

He also says he did not call Wegner any names, and that Wegner was the one who initiated a conversation with him.

Carlson says the section of the student newspaper including both pro and con viewpoints was pulled from extra copies of the newspaper at school, and no further action was taken.

But Mihet says his client was told he can no longer write for the student paper, and that's bad news for all student journalists.

"A student journalist has no choice but to fear punishment approaching any topic because they could end up just the same way that Brandon has ended up," Mihet said.

On January 31, a school district representative told NewsChannel 7 they've received hundreds of e-mails and telephone calls in support and opposition of the action.

    Don’t let the LGBT agenda a small percentage of public opinion influence. The argument of being born gay has been scientifically proven that there is no gay gene. This comes to no surprise to Christians who have always said that God did not create sin and instead Satan wants everyone to believe the lie! The truth is slow moving giving reason as to why the LGBT is eager to push gay marriage before it is widely known that being gay is a choice and not a virtue.

    I was wondering why the same people who can condemn Brandon for “hate speech” can say that this child is a brat or should be slapped? It that not a form of hate speech in itself…not to mention promoting child abuse.

    I get so sick and tired of hearing that life styles are not a choice and that they are in the genetic code. If that were true, then all the prison doors should be opened because people don't choose their life styles and should not be punished for being "born that way".

    Seeing the so-called tolerance on the left here, why should those against homosexuality have any tolerance for them? Christians don't hate the person, they hate the practice. Why isn't anyone allowed to have a different viewpoint from the left. So much for the people who say they support freedom of speech.

    This Brandon kid needs to be Hitch-slapped. You can't state in a public school newspaper that homosexuals are an abomination and should be put to death and not expect it to anger some people.. Spew your hate speech from the pews on Sunday to your fellow xtians and keep it out of the classroom. Read the rest of Leviticus and stop cherry picking. Have you worked on the Sabbath? DEATH! How about eating pork? Wearing clothes made from 2 different types of cloth? Right-o! Death again! Why would you say such hateful things about people you know nothing about? Gay is not a choice or a lifestyle. If it were, how can you explain why people would voluntarily come out only to be abused, rejected, and disowned by friends, family and most of the Xtian right? Jesus said nothing about homosexuality, ever. If it was so important, why did he fail to bring it up? Think. Please? The bible is not handed down from a god, and the only reason you are xtian is because of when and where you born.

      You are so wrong about Jesus and the bible. The word "sin" is translated two different ways with two different meanings. One means to offend and the other means to miss the mark. And don't bother trying to bring out the old testament laws when abortion is legal in this country. Who paid for your sins -Judas?

      I am just wondering why someone who is saying Brandon is hatful...then why can you say he should be as you put it Hitch-slapped...is that not hate speech because you don't agree with his religious beliefs?

    Real grist for learning. "How do we competently confront difficult topics?" One view: Scripture is truth, says damnation a risk, salvation possible. We are all sinners, all can be saved. Homosexuality is a sin." Other view: homosexuality is no social danger, not chosen or changeable, only a normal variation not deviation, gays are not just sexual but can Love maturely like straights can." Which view you choose, depends on not facts or logic, but prior value systems." IS THIS perhaps a learnable moment?! Seems so to me...

    EVERY state has laws that state what extortion is. This is a clear case of it if I have ever seen. Its also operating under the color of authority to do so and intimidation. The superintendent had better issue the apology and damned fast or this kid will file suit and the school system will LOSE both the civil and criminal trials. Yes, this is criminal and the kids counsel should refer it to the AG for state criminal charges. Extortion is a criminal offence whereby an individual obtains money, goods and services, or DESIRED BEHAVIOR from another by wrongfully threatening or inflicting harm to his person, property, or reputation. Extortion is a different criminal offense than robbery, whereby an offender steals property through force. Instead, the property gained though extortion is handed over to avoid threatened force or other harm. Extortion involves the victim's consent, but the way in which it is gained is unlawful, and therefore the entire act is considered a crime. The second the superintendent and principal said-expelled, they violated the kids constitutional rights, and state law.
