UPDATE: Outagamie Co. Woman Pleads Not Guilty in Fatal Texting Crash

APPLETON, Wis. (AP) -- A Fox Valley teenager has pleaded not guilty in a fatal crash that police say occurred because she was texting while driving.

Nineteen-year-old PaKou Xiong is charged in Outagamie County with homicide by negligent operation of a vehicle. Investigators reviewed Xiong's cell phone records and say they found an exchange of text messages in the moments leading up to the crash that killed James Weiss. He was biking in Kimberly when he was struck July 28.

The Post-Crescent says a trial is scheduled July 9. A conviction carries a maximum 10 years in prison and $25,000 in fines.

Charges have now filed against 19-year-old Outagamie County woman accused of texting while driving and causing a crash that fatally injured a man.

According to WLUK-TV, James Weiss, 46, was riding his bike shortly after midnight on July 28, 2012 in Little Chute, when investigators say he was struck from behind by PaKou Xiong. Prosecutors say there were no tire marks indicating Xiong's vehicle had attempted to stop. Weiss was taken to a Neenah hospital. He died on August 4th .

Weiss' bicycle did have lights and reflectors on it.

Xiong remains behind bars in the Outagamie County Jail. She's expected to be charged with homicide by negligent operation of a vehicle.
