A 48-year-old Merrill man is is charged with second degree sexual assault of an intoxicated victim and public fornication after a woman said her neighbor had sex with her while she was unconscious.
According to the criminal complaint, the alleged victim said she and the man had been drinking together the evening of October 14. The woman said she had two beers and two shots. The woman said she was not aware of what happened but woke in her apartment with no clothing below the waist.
The alleged victim's son said the neighbor brought his mother inside of their apartment by pulling her body on plastic sled.
The alleged victim said another neighbor also had an issue with the man and had since filed a restraining order. The woman said she believed the other woman had woken up an found the man standing over her in her bedroom.
During questioning the suspect said he and the women did have sex and he thought after they were done the woman went home, but he later found her asleep on the porch. He said he did take her to her apartment using the sled.
The woman was transported to the hospital to have a sexual assault exam performed. The man was arrested the next morning.
The man is free on a $10,000 bond after putting up the first $1,500 in cash.
