Judge: Wis. Abuse Victims' Civil Trial Can Proceed

An Outagamie County judge has ruled that two brothers molested by a priest can proceed with their lawsuit against the Diocese of Green Bay.
John Patrick Feeney was convicted of 2004 of sexually assaulting Todd and Troy Merryfield in 1978 when they were 12 and 14. The Merryfields are suing the diocese under fraud statutes.
Judge Nancy Krueger rejected a motion by the diocese to dismiss the case. The judge says there is adequate evidence the diocese knew that Feeney was a threat to children when it placed him in several parishes where he continued to have contact with children.
The Appleton Post-Crescent says the judge also rejected the diocese's claims that the six-year statute of limitations had expired.
An attorney representing the diocese did not immediately respond for comment.
