Judge Denies Wis. Chippewa's Night Deer Hunt Bid

MADISON, Wis. (AP) -- A federal judge says Wisconsin's Chippewa tribes can't hunt deer at night.

The state Department of Natural Resources has long banned night deer hunting out of safety concerns. The Chippewa agreed to abide by the prohibition when they were hashing out hunting and fishing treaty rights in front of U.S. District Judge Barbara Crabb two decades ago.

Now the tribes contend they should be allowed to hunt at night because the DNR has allowed the practice to contain chronic wasting disease and during last year's wolf hunt.

Crabb issued a decision Friday saying the Chippewa failed to show conditions have changed enough to warrant adjusting their treaty rights.

A spokeswoman for the Great Lakes Indian Fish and Wildlife Commission, which oversees the Chippewa's off-reservation rights, had no immediate comment.
