The attorney for Sean Janas is withdrawing a motion to ban a diary from her trial.
In a court hearing Monday (12/30/13), the attorney said he found evidence the diary was not obtained illegally.
Prosecutors say it contains entries about how Janas hated her ex-boyfriend's dog, abused it and hoped it would die.
The 21-year-old is charged with mistreating an animal and causing it's death. Prosecutors say she poisoned and stabbed the dog, named Mary to death last summer.
A defense motion to change the venue from Marathon County because of pre-trial publicity was denied by the judge.
Finally, a scheduling conflict with prosecutors could delay the trial which is scheduled to begin next month.
