MILWAUKEE (AP) -- A Milwaukee police detective beat a handcuffed suspect while a camera was rolling, but court records show that prosecutors don't want to give the video to the suspect's attorney.
The department has asked the district attorney's office to file criminal charges against Detective Rodolfo Gomez Jr. over the Aug. 14 incident.
The Milwaukee Journal Sentinel reports the recording shows Gomez punching Deron Love, who has pleaded not guilty in the death of his baby son.
Love's lawyer filed a motion to force prosecutors to turn over the video, as well as records of the internal affairs and criminal cases.
But prosecutors say they don't plan to call Gomez to testify against Love' so the details of the investigations and the video are irrelevant.
A hearing is set for next month.
