A two-day trial is scheduled to begin in Jan. for a 47-year-old Merrill man charged with hitting and killing a pedestrian last Oct.
Evan Mooney is charged with his 5th OWI, operating while revoked, and two separate counts of homicide. He remains in the Marathon County jail on a $30,000 cash bond.
According to the criminal complaint, around 3 p.m. on Oct. 28, 2013 Mooney struck and killed 86-year-old John Diktanas as he was walking on the shoulder of White Spire Road in Rothschild.
A Wisconsin State Crime Lab report indicates that Mooney had Marijuana, Hydrocodone and other controlled substances in his blood at the time of the crash.
The trial is expected to begin Jan. 27.
