The Tomahawk man convicted of killing a gas station clerk back in 2008, is denied a resentencing.
The decision was made yesterday.
Back in February, Derek Domke filed a motion to withdraw his guilty plea and be resentenced.
His attorney claimed his client suffered from mental health problems and should have never been allowed to plead guilty to the murder of 25-year-old Rochelle Anderson.
Domke is serving life in prison after pleading guilty to first degree intentional homicide and armed robbery last October.
Police say he beat and stabbed Rochelle Anderson to death at a Tomahawk gas station where she worked.
