NEW INFO : Man Accused of Rear-Ending Amish Buggy Being Held in Marathon County Jail
The man accused of crashing his minivan into an Amish Buggy is being held in the Marathon County Jail on a $10,000 cash bond.

The man accused of crashing his minivan into an Amish Buggy, killing a six week old infant is being held in the Marathon County Jail on a $10,000 cash bond.

Brian H. Witkus of Marshfield is charged with homicide by negligent operation of a vehicle.

Authorities say a mother and father, their 9-year-old son, and their 6 week old baby, Ada Mae Miller were in the buggy at the time.

Their six week old baby was thrown from the buggy and killed.

According to the criminal complaint, Witkus, a retired Veteran, was taking hydrocodone at the time of the accident.

Witkus says he hadn't drank alcohol since June.

He says he had reached down for a book that had fallen when he crashed into the buggy, but the state says he might have been impaired.

The state is awaiting blood test results to see if an OWI charge will be added.

His preliminary hearing is scheduled for August 19th.

If they prove that he wasn't impaired I don't think he should get the max sentencing. The Amish should have better safety for an infant, specially in this day in age. If some have LED lights, then they should also have a seat for infants and not hold a baby on the lap. That is just stupid!!! The Amish should also use less traveled roads for their safety, not one of the busiest streets at the busiest time. It sucks for the baby but there were many precautions the guy and the parents could have done to have this not happen. The truth is it was just an accident and I don't think this guy should have to suffer any more then the guilt. His life would be better off taking care of his sick mom then sitting in jail.

strange that the DA hasn't arrested the father for endangering the life of his child just because of his RELIGIOUS belief? and a child not in child saftey seat what are your standards?

i dont care if the guy is a vet he deserves to be in jail for the death of that baby he wasnt paying attention to driving i hope hes being eating alive by guilt i hope the book is thrown at him and maybe a amish buggy as well
