Harvath is charged with the murder of 23-year old Dirk Wolf.
The Stevens Point man was gunned down at the corner of Park and Dvision streets in Point last November.
Portage County District Attorney Tom Eagon says a court appointed psychologist ruled Harvath was insane at the time of the shooting and a second psychologist agreed.
Although both attorneys have agreed to the plea, Eagon says nothing is final until Harvath's next court appearance on November 1st.
