He says the court should act before huge sums of money are spent to expand casinos around the state.

Milwaukee County District Attorney Michael McCann also wrote in his brief, filed as an independent party, that the compact that Gov. Jim Doyle signed with the Forest County Potawatomi violates the state Constitution.

McCann, who like Doyle is a Democrat, is the latest party to weigh in on a lawsuit filed by Republicans who control the state Legislature. They argue the Potawatomi compact violates a 1993 amendment to the Constitution restricting gambling expansions.

The Supreme Court is deciding whether to take the case directly or require it to go through the lower courts first.
