Stan Hall is a small step closer to proving his deer farm is free from Chronic Wasting Disease.
A Portage County Judge ruled Thursday that the DNR must turn over DNA evidence for the judge to examine privately.
Stan Hall thinks the DNA evidence will prove a buck shot at his game farm in September did not have CWD.
When the deer was shot, a sample was sent to a lab in Ames Iowa, and the lab said the test was positive for CWD. But Stan Hall got the deer tested at another lab in Wyoming and this test came back negative.
Hall believes the original positive was not from his deer due to a mix up at the lab.
He asked the DNR to perform a DNA test to confirm the positive sample and his buck were the same. But the DNR has not released the results of the test because they say it is evidence in an ongoing investigation.
Hall's remaining herd is scheduled to be destroyed unless he can prove he never had CWD.
The judge will examine the DNA evidence and decide if he will give it to Stan Hall.
The DNR has until Jan. 21 to hand over the evidence.
