A victory for a snowboarder suing Granite Peak ski area.
The appeals court revived 28-year-old Ryan Cass' lawsuit accusing Granite Peak of negligence for injuries he suffered in 2003.
The court says Marathon County Judge Vincent Howard was wrong when he dismissed the suit because the release Cass signed does not apply to the negligent act of the employee in this case.
According to court records, Cass collided with a snowmobile driven by a Ski Hill worker. He suffered some permanent disabilities in the collision.
