The owner of Betty's Lunch in Weston is appealing seven littering citations she's received since July.

Marjorie Roth owes the village $1,026 in fines, mostly from junk metal on her property. But she doesn't think she should have to pay.

"We have people who drop off stuff continously, they figure they're helping him out and he's helping them out. It's a win win situation. This has been going on for years, even before I owned the property," Roth said.

Included on that property is an apartment attached to the restaurant, where her brother David Roth, a scrap metal collector, lives.

People drop off old washers and refrigerators, and then he sells the scrap to salvage yards. Most of the junk is kept behind a fence, but some things are left outside.

"I've been notified that my property is now a nuisance property and along with that comes a whole nother ball game," Roth said.

She admits there's sometimes junk, but that her brother is always picking it up.

Weston's administrator Dean Zuleger says the Roths have always been able to manage the junk, until this year.

"We've been able to work friendly and effectively with them on how they want to use their property. We weren't able to achieve that this year," Zuleger said.

Still, Roth says her customers have been loyal.

"Everybody's like, you keep up the fight, they don't see a problem, they don't have an issue."

The property owner was also reprimanded this spring when she allowed a produce stand on her property without the village's consent.
